Kelly Rutherford Gets a Restraining Order Against Her Estranged Hubbie

Kelly Rutherford, of Gossip Girl fame, has filed a restraining order against her husband. She claims her estranged hubbie, Daniel Giersch, has harrassed her family and nanny during the bittle custody war over their two children. Rutherford claims that Giersch’s harrassment has caused her undue stress which has negatively impacted her ability to produce breastmilk. TMI, Kelly. Seriously. Gossip Girl’s Kelly Rutherford has given birth to a baby girl on Monday night in Los Angeles. The actress already has a two year old son, Hermes, with a local do-nothing, Daniel Giersch. The ex-couple has been in a nasty custody battle for the past six months, with Rutherford claiming the children are in danger while with him.  Giersch was not present for the birth of the child. A judge ruled Friday morning that Gossip Girl MILF Kelly Rutherford will be allowed to take her two-year-old son, Hermes, to NYC with her while she films the hit series. Judge Michael Levanas based his decision off of the fact that Rutherford has a contractual agreement to be in NYC to film the scenes, and estranged husband Daniel Hiersch  has no work preventing him from going to NYC to be close to his son during that time as well.
